These Conditions do not regulate, however, the provision of services or the sale of products by parties other than Free Shop Frontiera S.A. that are present on www.freeshopswiss.ch via links, banners or other hypertext connections.
The Conditions apply exclusively to sales contracts with buyers, as provided for by the Swiss Federal Law against Unfair Competition (LCSI), art. 3, paragraph 1, in force since April 2012: “Anyone who offers goods, works or services via electronic commerce, omitting to indicate clearly and completely his identity and his contact address, including his email address, acts unfairly” and by the European Law, art. 2 paragraph 3, of 6 April 2010, which regulates online sales.
1.1 Free Shop Frontiera S.A. (hereinafter, and for brevity, “FREE SHOP“), operating through an online platform (www.freeshopswiss.ch; hereinafter, and for brevity, “the Portal”), has as its corporate purpose the sale and promotion of the sale of products (hereinafter, and for brevity, “the Products”) of companies (hereinafter, and for brevity, “the Partner“) to third parties of legal age (hereinafter, and for brevity, “the Customers/Customer”).
1.2 With these Conditions, FREE SHOP sells and the Customer purchases remotely the tangible movable goods indicated and offered for sale on the Portal. The contract is concluded exclusively through the Internet, through the Customer’s access to the Portal and the creation of a purchase order according to the procedure provided by the site itself and by these Conditions.
1.3 The Customer undertakes to read, before confirming his/her order, these Conditions, in particular the pre-contractual information provided by FREE SHOP and to accept them by placing a flag in the indicated box.
1.4 The Products sold on the Portal can be purchased and delivered exclusively in the countries indicated during the purchase order procedure. Any orders for shipments to be made outside of these countries will be automatically rejected during the order processing procedure.
2.1 Simply registering gives you the status of “registered” Customer, allowing you to carry out transactions through the Portal.
2.2 To register, you must select the appropriate “Register” section and accept these Conditions, which also contain information on the processing of personal data by FREE SHOP.
2.3 By making a purchase through our portal, you agree to receive marketing communications from us via the email address provided during the purchase process. These communications may include information about our products, services, promotions and special offers. We guarantee that your email address will not be given, sold or provided to third parties for any reason without your express consent. We will only use your email address for our internal marketing communications and you can unsubscribe at any time by following the instructions provided in each marketing email you receive from us.
3.1 Registered Customers may update and rectify the personal information communicated to FREE SHOP at any time.
3.2 To correct or update the personal information entered, you must access the address www.freeshopswiss.ch in the section “My profile” – “Account details”.
3.2 Customers are responsible for the truthfulness and accuracy of the personal data entered while FREE SHOP will not assume any responsibility in this regard. By placing an order through the Portal, the Customer guarantees that he or she is of legal age according to the Law of his or her Country of origin and that he or she has the legal capacity to enter into binding contracts.
3.3 Customers may cancel their subscription/registration from the portal at any time.
3.4 In case you do not wish to receive all or some of the FREE SHOP newsletters, you can unsubscribe from the service by clicking on the link that appears at the bottom of each newsletter when you receive the mail.
4.1 Before concluding the purchase contract, the Customer examines the characteristics of the goods which are illustrated in the individual product sheets at the time the Customer chooses the product.
4.2 Before the conclusion of the purchase contract and before the validation of the order with obligation to pay, the Customer is informed regarding:
The Products that cannot be purchased are sold out until new availability. It is not possible to recover an out of stock product. FREE SHOP can accept the Customer’s orders within the limits of the quantities of the existing requested Products. Therefore, the acceptance by FREE SHOP of the purchase proposal forwarded by the Customer is subject to the availability of the Products themselves. FREE SHOP undertakes to promptly communicate to the Customer any unforeseeable stock shortages due to excess demand or other causes.
6.1 The prices published are expressed in Swiss Francs (CHF), VAT included and are those available at the time of registration of the order, in the event of a reduction in value, no difference will be recognized on the amount previously paid. FREE SHOP reserves the right to change prices at any time.
6.2 The prices shown for each Product do not include shipping costs, which are indicated separately and calculated as set out in point 7.2.
6.3 These costs are therefore the responsibility of the Customer and must be paid directly upon delivery of the Products, according to the instructions specified in the Order confirmation. In the event of non-payment, the Customer assumes all costs and responsibilities.
7.1 FREE SHOP undertakes to ensure that the delivery of the product to the customer takes place within 7 days of the conclusion of the sales contract.
7.2. The amount of shipping costs will be calculated from time to time based on the actual weight of the Products purchased and based on the country of destination of the same.
8.1 The sales contract will be considered concluded only if FREE SHOP has successfully recorded the payment by the Customer. In the event that the payment is not successful at first (e.g. due to the non-existence of the indicated bank account, lack of coverage, incorrect credit card number or credit card limit being reached), the contract will not be considered valid.
8.2 Once the contract has been concluded, a copy of the order and the applicable Conditions will be kept by FREE SHOP in its computer archives. The Customer will have access to all information relating to the order and the applicable conditions by accessing the “My Profile” section within his/her Account.
8.3 FREE SHOP reserves the right to refuse orders from a Customer with whom there is an ongoing legal dispute relating to a previous order. This applies equally to all cases in which FREE SHOP deems the Customer unsuitable, including, by way of example, the case of previous violations of the conditions of the contract for online purchases on the Portal or for any other legitimate reason, especially if the Customer has been involved in fraudulent activities of any kind.
9.1 Payment of the price may be made by credit card (Visa, Mastercard, American Express, Visa Electron and/or other credit cards accepted by FREE SHOP).
9.2 In the event of conclusion of the contract, FREE SHOP will charge the purchase amount to the credit card indicated. In the event of payment by bank transfer, the order will be effective only after the amount has been credited to the FREE SHOP current account.
9.3 The amounts to be charged may be blocked at the moment of conclusion of the purchase process, even if the actual debit occurs at a later time.
9.4 The invoice is sent upon request by the Customer by email upon receipt of payment.
9.5 The Customer will be required to notify FREE SHOP of any anomalous or undue charges, by email to info@freeshopfrontiera.ch, as soon as he becomes aware of them, in order to allow FREE SHOP to carry out the appropriate checks.
9.6 The Customer has the right to a refund (through re-crediting pursuant to art. 9.9) of the amounts charged in the following cases:
9.7 The Customer must submit his/her complaint within 3 working days of the occurrence of the poor service, communicating it to FREE SHOP by email info@freeshopfrontiera.ch or by calling 0041 (0)91 6467471. FREE SHOP will carry out the appropriate checks and will respond to the Customer within 15 working days;
9.8 In the event of partial use of the service, the refund may be in proportion to the service used by the Customer.
9.9 Refunds are always made directly to the same credit card used for the purchase or, in the case of payment by bank transfer, to the ordering party’s current account. FREE SHOP is in no way expected to make a bank transfer or credit the refund amount to a different card/bank account or to be registered to someone else.
9.10 FREE SHOP will communicate to the Customer the acceptance and the expected timeframes to obtain the refund and to have visibility on the current account associated with the card used for the purchase. Below are the maximum timeframes necessary to manage the refund process starting from the request received by contacting Customer Care customercare@freeshopfrontiera.ch:
Furthermore, it will be necessary to wait for the specific banking times to have visibility of the re-credit, usually from 7 to 30 days, depending on the conditions of the reference Credit Institute.
9.11 FREE SHOP has no power to intervene regarding the re-crediting times which are at the discretion of the relevant Banking Institution.
9.12 In the event of delivery of an incorrect product compared to the order, the Customer must return the incorrect product to FREE SHOP FRONTIERA S.A. via Angelo Maspoli 21 6850 Mendrisio – Switzerland. Shipping costs are borne by FREE SHOP, which will, once the return has been received, always ship the replacement product at its own expense. This clause lapses if the incorrect product is not returned to FREE SHOP in intact conditions and including the original packaging.
10.1 You may decide to request a refund of the price or alternatively obtain a reduction on the price of a different Product if the product is not intact and compliant. Additional or concomitant legal rights relating to the guarantee are excluded – within the limits established by the provisions of law. Damage attributable to normal wear and tear of the Product, improper use, insufficient or inadequate maintenance of the same are excluded from the guarantee. Please carefully keep the documentation certifying the start of the guarantee period (order coupon, delivery note, etc.).
10.2 On the Portal we have done our best to reproduce the colours of our products in such a way that they are as close as possible to the original. Since the quality of the images also depends on your screen, we cannot guarantee that all colours are reproduced in a manner that is perfectly compliant with the original. Any discrepancies in terms of colour are not to be considered anomalies or defects. Defects evident at the time of delivery must be contested within 10 days. With regard to defects that emerge at a later time, the Customer is required to inform FREE SHOP immediately by e-mail info@freeshopfrontiera.ch or by telephone no later than 10 days after the defect was discovered. If the complaint is not made within the indicated time frame, we will assume that you are satisfied with the Product.
11.1 FREE SHOP assumes no responsibility for the improper or incorrect use of the Products by the Customer. FREE SHOP is not liable for the condition of the Products due to improper storage after delivery. It is recommended to read the instructions for use on the packaging or contact FREE SHOP for any assistance regarding the storage of some Products.
All information contained in the Portal, all trademarks reproduced in the Portal, all programs and/or technologies provided in relation to the Portal and, more generally, all or part of the site www.freeshopswiss.ch (and the sites connected to it), are reserved and protected. It is forbidden to reproduce trademarks and logos in use on the Portal: the Customer also undertakes not to copy, modify, translate, reproduce, distribute, sell, publish, enhance and distribute in any other way, in a different format, in electronic or other form, all or part of the information (even partial) present on the Portal and the objects purchased from it. The trademark “FREESHOP PERFUMES & COSMETICS” is the exclusive property of FREE SHOP.
The relationship between FREE SHOP and the Customers is governed by the Conditions published on the Portal at the time of purchase by the Customer. The validation of the order by the Customer implies acceptance of the Conditions fully and without reservations. To validate the order, the Customer must click on the ‘Confirm’ button. FREE SHOP will send the Customer an email notifying the receipt of the proposal to the email address provided by the Customer. FREE SHOP will then send a summary email to confirm the order. In the order confirmation email, the Customer will also receive the link to download and archive a copy of these Conditions.
14.1 These Conditions are governed by Swiss law and will be interpreted in accordance with it, without prejudice to any other mandatory prevailing rule of the country of habitual residence of the Customer. Consequently, the interpretation, execution and termination of the Conditions are subject exclusively to Swiss law and any disputes inherent and/or consequent to the same must be resolved exclusively by the Swiss judicial authority: the competent court to resolve any dispute relating to this contract is exclusively that of the FREE SHOP headquarters.
